Man accused of murder faces life in prison, no parole

RANCHO CUCAMONGA - The District Attorney's Office will not seek the death penalty against a former martial arts fighter accused of using an inescapable chokehold to strangle his girlfriend's husband. Prosecutors would not elaborate on the specifics but said Monday they weighed a number of factors, including Rafiel Torre's lack of serious criminal record, in choosing to instead seek a sentence of life in prison without possibility of parole if Torre is convicted of the Dec. 21, 2001, murder of Bryan Richards.
Prosecutors say Torre killed Richards so he could maintain his love affair with Richards' wife and live off the man's $1 million life insurance policy. Torre appeared in West Valley Superior Court on Monday and again pleaded not guilty to the charges.
One of Torre's former friends and students testified during a preliminary hearing in June that Torre confessed to killing Richards, but claimed he did so in self-defense. Gerald Strebendt, a professional cage fighter, said Torre claimed to have used a "rear choke,' a powerful jujitsu move that can render a man unconscious in seconds and can be fatal if applied too long.
Richards was found strangled to death in the bed of his pickup truck in the parking lot of the Albertsons supermarket at Vineyard Avenue and Foothill Boulevard by relatives who went looking for him when he did not come home one night.
Richards' family later filed a lawsuit accusing Richards' widow, Angelina, of involvement in themurder. She has not been charged with any crimes.
Richards' family issued a statement through its attorney Monday saying it was comfortable with the district attorney's decision to take the death penalty off the table." Although understandably disappointed, we support the district attorney's decision and law enforcement's efforts to bring Rafiel Torre and all those involved in Bryan's murder to justice,' the family wrote.
